By accessing or using Originly ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Platform Role & Safe Harbor
Originly is an intermediary platform that hosts user-submitted content. Originly does not create, endorse, or verify the legality of content uploaded by users. We provide the technology infrastructure for creators to share digital resources with others.
Originly operates as a neutral hosting service and qualifies for safe harbor protections under applicable laws, including but not limited to the Digital Millennium Copyright Act (DMCA) and similar legislation in other jurisdictions.
3. User Responsibility
Users are solely responsible for the content they upload, share, or distribute through Originly. This includes ensuring that:
- They have the legal right to share the content they upload
- Their content does not infringe on any third-party rights
- Their content complies with all applicable laws and regulations
- Their content does not violate our Content Policy or these Terms
4. Copyright Ownership Declaration
By uploading content to Originly, you confirm and warrant that:
- You own the content or have obtained all necessary rights, licenses, and permissions to distribute it
- Your content does not infringe on any copyright, trademark, or other intellectual property rights of any third party
- You have the authority to grant Originly the rights described in these Terms
You retain ownership of your content. By uploading content, you grant Originly a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content through the Platform.
5. Prohibited Content
The following content is strictly prohibited on Originly:
- Pornographic or sexually explicit content — including but not limited to images, videos, or text depicting sexual acts
- Content involving minors in any harmful or inappropriate context — Zero tolerance policy applies
- Copyright-infringing material — content you do not have rights to distribute
- Pirated content — including books, courses, movies, software, or other copyrighted works
- Hate speech, harassment, or violent content — targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Content promoting illegal activities — including fraud, hacking, drug distribution, or other unlawful acts
- Malware or harmful software — any files designed to damage, disrupt, or gain unauthorized access to computer systems
- Personal or confidential information — of third parties without their consent
6. Right to Remove Content
Originly reserves the right to remove any content at its sole discretion, with or without notice. This includes but is not limited to content that:
- Violates these Terms of Service
- Violates our Content Policy
- Is the subject of a valid copyright complaint
- We believe poses a risk to our users or the Platform
- Is otherwise objectionable in our judgment
7. Account Termination
Repeated or severe violations of these Terms may result in:
- Temporary suspension of your account
- Permanent termination of your account
- Removal of all content associated with your account
- Prohibition from creating new accounts
We are not required to provide warnings before taking action and may act immediately for severe violations.
8. Limitation of Liability
Originly is provided "as is" without warranties of any kind. To the fullest extent permitted by law:
- We do not guarantee the accuracy, completeness, or legality of user-uploaded content
- We are not liable for any damages arising from your use of the Platform or user-uploaded content
- We are not responsible for any loss of data, revenue, or profits
9. Indemnification
You agree to indemnify and hold harmless Originly, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform
- Your uploaded content
- Your violation of these Terms
- Your violation of any rights of a third party
10. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes by posting a notice on the Platform. Your continued use of Originly after changes are posted constitutes acceptance of the updated Terms.
